Default Land Surveyor?

Anyone?

Or have a cheap recomendation.

Fun land problem. My deed and my neighbors deed both say we own a 25' strip of land. The 25' stops him from building a garage, driveway and tearing out one of my 30-40 year old oaks. Anyone have any idea wtf is going to come of this?

Shouldnt he have to pay for the survey? When he applies for his permit the town needs to verify everything before they approve it. First thing i would do is go to the town hall and get a copy of your plot drawings. I would bet he is trying to pull a fast one on you. Your plot will show exactly where your property edge and markers should be and it will cost just a few dollers.

I have the town maps and my deed. My deed shows the strips I own clear as day because I am a middle lot. His lot is the corner so his deed shows distance from the corner. The problem is, they overlap by about 25'. I've even found the original lead steaks from 1947.

The stake should override the diatances from the corner as the road might have been widened and changed shape over the years.

Is the distance from his corner to a specific point (i.e. monument, PK, etc), go along something like the roadway, or does it have a bearing? You can't have just a distance from a point and get an accurate measurement.

His deed says Eastern edge 100' +/- from Fowler ave, however each strip on the town map is 25'. So on my deed, I own from strip 4-strip 7. Meaning he has 1 - 3 which should only be 75'. So strip 4, is in dispute.

What I think/hope happened was the widened the Fowler Ave eons ago and never updated his deed but updated the maps.

Tell me about it, guy moved in under a month ago. I feel like a dick, yet at the same time. I'm not giving him land, to build a driveway and garage and take my property value from both land loss and the eye sore.
